RULES (Apartment Rental)

General Terms

  1. These terms and conditions (hereinafter – the “Terms”) form an integral part of the short-term apartment rental agreement in Svencelė and Kunigiškiai (hereinafter – the “Agreement”), which is concluded between the Renter and the Landlord based on a reservation submitted by the Renter through the websites www.mariosirjura.lt or www.hospitable.com (hereinafter – the “Website”), by phone, email, or other communication channels.

  2. Definitions:

Reservation – a short-term rental service provided through www.mariosirjura.lt or www.hospitable.com, managed and administered by MB ELTUVA, registered at Girios g. 114A, LT-47252 Kaunas, email info@mariosirjura.lt, phone +37064985903, offering and administering short-term apartment rentals under these Terms.
Landlord – MB ELTUVA, registered at Girios g. 114A, LT-47252 Kaunas, email info@mariosirjura.lt, phone +37064985903.
Renter – an individual or a legal entity renting an apartment or purchasing other services of the Landlord via www.mariosirjura.lt or www.hospitable.com. Only adults and legal entities acting through authorized representatives may be Renters.
Reservation confirmation – confirmation received from the Website regarding the Renter’s submitted reservation.
Check-in – the process when the Renter arrives at the accommodation and the rental period begins.
Check-out – the process when the Renter vacates the accommodation.

  1. The Agreement is considered concluded when the Renter submits a reservation, selects a payment method, provides necessary data, and receives the Landlord’s reservation confirmation. The Agreement remains valid until the end of the rental period or termination under these Terms or applicable legislation.

  2. The Terms are a binding document defining the Renter’s and Landlord’s rights and obligations related to reservations, payments, check-in, check-out, and other rental aspects on the Website.

  3. The Landlord has the right to change or supplement the Terms at any time. Registered Renters will be informed about any changes and must accept the updated Terms to continue using the services. Changes become effective only for reservations made after the update.

  4. These Terms take effect from the date of publication and replace all previous Website-related reservation rules.

  5. Reservations are accepted only in the locations specified on the Website.

  6. By submitting a reservation, the Renter confirms that they have read, understood, and agree to the Terms.

  7. All notices to the Renter will be sent by the Landlord to the email address provided during registration or reservation. The Renter must use the contact details listed on the Website to contact the Landlord.

  8. The Landlord may restrict or terminate the Renter’s access to the Website services if the Renter violates the Terms or attempts to compromise the stability or security of the Website.

  9. In case of force majeure, the Landlord may temporarily suspend execution of the Agreement until the circumstances end, notifying the Renter. If execution of the Agreement is no longer relevant to the Renter, they may cancel the Agreement by informing the Landlord.

  10. The Landlord may temporarily suspend or terminate the Website’s operation by publicly announcing it on the Website. Prior to suspension or termination, confirmed reservations will be honored according to the Terms.


Renter Registration and Data Protection

  1. The Renter may use the Website and make reservations by providing their email, mobile phone number, and other required data. Additional information may be required, such as name, surname, contact details, or payment card information.

  2. The Renter is responsible for the accuracy and completeness of the provided information. If data changes, the Renter must update it immediately. The Landlord is not liable for damage arising from inaccurate or outdated information.

  3. Mandatory notifications regarding reservations, purchased services, and account registration will be sent regardless of the Renter’s settings or preferences.

  4. The Landlord has the right to collect and manage the Renter’s data for reservation management, processing, and analytical purposes. Information may be used for marketing purposes with the Renter’s consent or in accordance with Lithuanian law. The Landlord’s data protection rules are defined in the Privacy Policy.


Renter’s Rights

  1. The Renter has the right to rent apartments according to these Terms and the sales conditions applicable at the time of reservation.

  2. The Renter has the right to cancel the Agreement as described in the apartment rental conditions listed below.

  3. The Renter must inform the Landlord of cancellation by submitting a completed cancellation form or a clear statement using the provided contact details.

  4. The Renter must vacate the apartment by the agreed check-out time and is liable for any damage caused during the rental period.

  5. Refunds for canceled reservations will be processed within 14 days from the cancellation notice, provided the Renter is not responsible for any damage to the apartment and meets the cancellation conditions listed below.


Renter’s Obligations

  1. The Renter must follow these Terms and Lithuanian law when using the Website and rented apartments.

  2. The Renter must pay the full rental amount and any additional services in advance according to the payment procedure below.

  3. The Renter must update their registration data whenever it changes.

  4. The Renter may not transfer their account or reservation details to third parties under any circumstances.

  5. If the Renter violates these Terms, the Landlord has the right to terminate the Agreement and require the Renter to immediately vacate the apartment.


Reservation Procedure

  1. A reservation is considered completed when the Renter receives an email confirming the reservation.

  2. The Renter must adhere to agreed check-in and check-out times. Early arrival does not grant access to the accommodation.

  3. If the apartment becomes unavailable due to unforeseen circumstances, the Landlord will offer a similar or better alternative. If the Renter does not accept it, they may cancel the reservation and receive a full refund.

  4. The Renter must inspect the apartment upon arrival and immediately report any issues.


Prices, Payment Terms, and Deadlines

  1. Prices are listed in euros (EUR) and include all applicable taxes and fees. Prices must be displayed during the reservation process.

  2. Before the check-in date, the Renter must pay for the reservation and additional services via the payment methods listed on the Website.


Final Provisions

  1. These Terms are governed by the laws of the Republic of Lithuania.

  2. Damages must be compensated by the liable party according to Lithuanian law.

  3. Any disputes arising from these Terms shall be resolved through negotiation. If no agreement is reached, disputes will be handled according to Lithuanian law.

  4. Renters may submit claims to the State Consumer Rights Protection Authority or the EU Online Dispute Resolution platform.
